Terms and Conditions

1. Scope and Definitions
These provisions (hereinafter referred to as "GTC") apply to all transactions between the company Formfeld (hereinafter referred to as "seller") and the customer (hereinafter referred to as "buyer"), unless expressly agreed otherwise.
2. Offer and conclusion of contract
The presentation of the products on the seller's website does not constitute a legally binding offer, but an invitation to order. The buyer can place his order by telephone, in writing or by e-mail. The contract is only concluded when the seller confirms the order in writing or by email. The automatic order confirmation does not constitute acceptance of the offer.
After ordering, the selected structural patterns is excluded from the selection for subsequent buyers and implemented individually in production, therefore changing the selection of the structure is no longer possible once the order has been placed. This applies to the same extent to the selection of the desired format, the type of perforation and the material.
3. Subject of the contract
The wall panels produced and offered by the seller are unique pieces and can be ordered by the customer after prior digital preview and viewing. The dimensions, materials, structural patterns, and perforations are at the customer's choice and can be determined by the customer by selecting the corresponding options available to them. Due to the representations and the nature of the natural materials, deviations from the actual appearance of the panels may arise. In particular, the preview only represents the shape and format of the future panels without taking into account the selected material.
4. Delivery and Installation
Delivery will be made to the address specified by the buyer. The buyer bears the shipping costs unless otherwise agreed. The seller reserves the right to choose the shipping method at their discretion.
The production of a Formfeld1 panel usually takes six to nine weeks from the time of order, with an additional processing time of two weeks for panels with micro-perforation. Delivery will be made immediately after production in consultation with the buyer.
If production or delivery is delayed, the buyer will be informed immediately. Such a delay may result from the fact that the wood blanks used are not always available according to our special quality requirements. We hope for your understanding that the quality of our panels is prioritized over the delivery time. In case of force majeure or other unforeseen events beyond the control of the seller, the production and delivery time will be extended accordingly.
The seller does not provide installation services for the panels. The panels come with instructions for self-installation by the buyer.
5. Payment Terms and Retention of Title
The payment terms are generally agreed upon between the seller and the buyer. Unless otherwise agreed, the purchase price is due immediately after ordering. Payment can be made by bank transfer or through the services of ShopPay, PayPal, and Google Pay. The buyer can find information on how to use each service in the information provided by the respective service. In case of payment delays, the seller is entitled to charge default interest of 5% above the base rate.
The delivered products remain the property of the seller until full payment has been received.
6. Defects and Warranty
The seller warrants that the delivered products are free from material and manufacturing defects. Fine branches, knots and ingrowths, color and brightness differences between adjacent solid wood slats, as well as other natural variations in the wood are not considered defects. The buyer must report defects immediately in writing upon discovery. In the event of a justified complaint about defects, the seller warrants the repair or replacement of the affected panel. Further claims by the customer are excluded.
The buyer does not have a right of withdrawal due to the individual production according to the buyer's selection.
7. Liability
Our company is not liable for damages caused by improper use, installation or storage of the wall panels. We also do not accept liability for consequential damages resulting from the use of the panels.
Further claims by the buyer, particularly for compensation, are excluded to the extent legally permissible, unless they are based on gross negligence or intent of the seller.
8. Data Protection
The seller collects and uses the buyer's personal data exclusively for the purpose of fulfilling the contract. The seller undertakes to treat the buyer's personal data confidentially and to use it only within the framework of the legal provisions. The data will not be passed on to third parties unless this is necessary for the purpose of fulfilling the contract. 9. General Provisions
Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
German law applies. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. The place of jurisdiction is our company headquarters in Munich.
